Whilst we obviously live in a data-driven society, the regulation of the data economy has just started. The GDPR protects individual rights and imposes obligations on the market players. As opposed to this, data economy law is supposed to facilitate the digital transformation of economies.

EU Data Act

The EU Data Act is supposed to grant fair access to data and to facilitate use of data. It is intended unlock the economic potential of data and technologies by clarifying who can create value from data and under which conditions. And it should contribute to creating a EU market where data can flow freely and across sectors.

It aims at giving both individuals and businesses more control over their data through a portability right, copying or transferring data easily from across different services. It will grant access rights, where data are generated through smart objects, machines, and devices.

At the same time, it will create obligations and compliance duties.

EU Governance Act

The EU Data Governance Act facilitates data sharing by companies, individuals and the public sector. The first section deals with data sharing by the public sector. The second sets up conditions for intermediaries like data market places.
